Are 13 "coincidences" invoices true or false?

In the early stage, according to the clues of public security organs and the comprehensive analysis of tax big data, the Inspection Bureau of Suzhou Industrial Park Taxation Bureau found that 13 ordinary VAT invoices obtained by Lisoft Company were very suspicious. Three companies, such as Shanghai Yunyi Network Technology Co., Ltd., which are the issuers of invoices, were established within one week, and their invoicing time was the same day. The names of the invoices were all "* information technology services * software service fees", and two of them had the same registered address.

Upon further inspection, the inspectors found that the three billing parties were punished by the market supervision and management department for "stopping business for more than six months after opening" at almost the same time, and their business licenses were revoked two months later. This situation is obviously not a normal business state.

Did the three companies really provide "information technology services" to PowerSoft? Why is the invoice issued on the same day "exactly" after providing the service? After issuing the invoice, it is so coincidental to enter the "closed" state at the same time? Is this "coincidence" or "premeditated"?

After further analysis of the tax return of Power Soft Company by inspectors, it was found that the taxable income of corporate income tax in that year was 2,884,300 yuan. According to the relevant provisions of the preferential income tax policy for small and meager profit enterprises, "small and meager profit enterprises refer to enterprises engaged in industries that are not restricted or prohibited by the state, and at the same time meet the three conditions of annual taxable income not exceeding 3 million yuan, employees not exceeding 300, and total assets not exceeding 50 million yuan." Then, is there any artificial adjustment in the annual taxable income close to the "preferential limit" of Soft Power Company to defraud the preferential qualification? Are there real business transactions behind the 13 invoices? The inspectors can’t help but wonder.

Why are accounts payable for more than three years delayed?

Combined with the previous analysis, the inspectors interviewed the agent bookkeeping accountant of Lisoft Company according to law and asked him to provide relevant materials to cooperate with the inspection. Among the materials related to production and operation provided by the company, the inspectors did not find the business contracts signed with three billing parties, the project plan, operation and maintenance manual or user manual required for the information technology service shown in the invoice, and did not find any business-related communication supporting materials. Only invoices and accounting vouchers are not enough to prove the real existence of the business.

In order to further clarify the truth, the inspectors started with the flow of funds. The company’s accounting voucher shows that the total amount of the 13 fare issuance taxes is 1,200,100 yuan, which has been charged to the "accounts payable" account. At the same time, after checking the details of the company’s bank account, it is not found that it has paid any money to three billing parties. As of the time of inspection, the above-mentioned money for more than three years is still in the "unpaid" state. There are indications that the 13 invoices obtained by Power Soft Company are suspected of being falsely issued.

It is not worth the loss to enjoy tax incentives in violation of regulations.

The inspectors interviewed Li, the legal representative of Lisoft Company, according to legal procedures, and explained to him the relevant regulations on tax management, declaration and payment, financial accounting, tax collection and management, etc. In the face of complete evidence, Li had to admit that the company obtained these 13 ordinary VAT invoices by paying the "billing fee" without real business, and recorded them as "main business cost", which was illegally charged before enterprise income tax, thus reducing the taxable income to defraud the preferential qualification.

The company should have applied the corporate income tax rate of 25%, but in the reporting year, it violated the rules and enjoyed the preferential policies of small-scale and low-profit corporate income tax, that is, "the annual taxable income does not exceed 1 million yuan, and the corporate income tax is paid at the actual tax rate of 5%; The annual taxable income exceeds 1 million yuan but not more than 3 million yuan, and the enterprise income tax is paid at the actual tax rate of 10% (further reduced to 5% since 2022), in order to achieve the purpose of paying less enterprise income tax. However, this behavior has not escaped the investigation of the tax authorities in the end.

According to Article 12 of the Measures for the Administration of Pre-tax Deduction Vouchers for Enterprise Income Tax, invoices that are privately printed, forged, altered, voided, illegally obtained by the drawer, falsely made out, and filled out irregularly, and other external vouchers that are not in compliance with national laws, regulations and other relevant provisions shall not be used as pre-tax deduction vouchers. The false VAT invoice obtained by Power Soft Company belongs to the above-mentioned provisions, and the tax authorities accordingly require it to increase the taxable income by 1,200,100 yuan, and require it to pay back the enterprise income tax by 782,700 yuan according to law.

According to the first paragraph of Article 63 of the Tax Collection and Administration Law of People’s Republic of China (PRC), a taxpayer who forges, alters, conceals or destroys account books and vouchers without authorization, or lists more expenses or omits or omits income in the account books, or refuses to declare or makes false tax returns after being notified by the tax authorities, and fails to pay or underpays the tax payable is tax evasion. If a taxpayer evades taxes, the tax authorities shall recover the taxes and late fees that he fails to pay or underpays, and impose a fine of not less than 50% but not more than five times the taxes that he fails to pay or underpays; If a crime is constituted, criminal responsibility shall be investigated according to law.

　　Chen Shuguo, 37, is an associate professor and doctoral supervisor at Sanya Institute of Oceanography, China Ocean University, and a part-time researcher at the National Satellite Ocean Application Center. He has been studying marine optical remote sensing for more than ten years, and the on-orbit alternative calibration algorithm of marine optical satellites developed by his team is serving the operational calibration system of China’s independent marine color satellites Haiyang-1 C and Haiyang-1 D. In recent years, Chen Shuguo is in charge of the project "Technical Development of Synchronous Observation System for Marine Water and Atmosphere", which has realized long-term, continuous and stable observation of optical parameters of water and atmosphere, and will be applied to the inspection of marine remote sensing products of Haiyang-1 series satellites and a new generation of water color observation satellites.

　　Chen Shuguo became attached to marine optical remote sensing in 2009. That year, he was admitted to China Ocean University as a postgraduate majoring in marine information detection and processing, and saw the sea for the first time.

　　"I am determined to engage in academics." Chen Shuguo’s academic enthusiasm has never wavered since he first entered school. After graduating from Ph.D., he continued to stay at his alma mater to study the basic theory and innovative application of marine optics.

Remote sensing of ocean water color is to analyze the spectral characteristics by receiving these scattered energy and deduce the optical composition of water body. " Chen Shuguo explained, "These detection data play an important role in China’s maritime rights and interests maintenance, marine resources development, marine environmental monitoring and marine disaster prediction."

　　The most efficient and effective way to observe the ocean by remote sensing is to launch ocean satellites. Since the launch of the first ocean color test satellite, Ocean No.1 A, in 2002, China’s ocean satellites have developed for 20 years, and China’s autonomous ocean satellite optical remote sensor is also moving towards the "last mile" of full autonomy.

　　Calibration refers to the process of converting satellite observation data into real radiation. 　　While doing theoretical deduction and finding the best algorithm, the site selection of calibration field is determined through comprehensive analysis of a large number of data. One month before the launch of Haiyang-1 C satellite, Chen Shuguo led a team to develop an on-orbit alternative calibration algorithm for China autonomous ocean color satellite.

　　Ocean optics and water color remote sensing are disciplines based on field measurement. In order to obtain comprehensive field observation data of ocean optics, Chen Shuguo has worked in the observation line for many years, taking the swaying deck as the second laboratory and writing papers on the ocean.

　　For Chen Shuguo, the sea is an unpredictable "old friend". Although he has been dealing with it for more than 10 years and knows it better than others, Chen Shuguo is still looking forward to and uneasy every time he puts the observation instrument into the water for measurement. "Ocean observation not only has bad sea conditions, but also is accompanied by various unknown factors underwater. Changing all the time is the essence of the ocean. "

　　Observation at sea, a voyage is about 20 days. Due to the heavy scientific research tasks, Chen Shuguo once slept less than 4 hours a day on several voyages. 　　Why did the thought change from "zero confession" to writing a confession?

　　In July 2019, a letter sent from Panyu District Detention Center in Guangzhou was placed on the desk of He Xiongwei, the prosecutor of Guangdong Provincial People’s Procuratorate. The letter was sent by Liu Youdi, a criminal in a drug trafficking case. She wrote in the letter, "Please meet He Xiongwei. Now I am willing to plead guilty, admit my mistake and truthfully explain the case." Just a month ago, Liu Youdi was sentenced to life imprisonment by the Guangdong Higher People’s Court for drug trafficking. In court, she never pleaded guilty. So what makes her mind change so dramatically now? What kind of waves are behind this drug case?

　　On December 21, 2015, the Public Security Bureau of Panyu District, Guangzhou received a report that someone was dealing in drugs near a building in Panyu District. After grasping the clues, the police immediately went to arrest. The location of the arrest was in an alley. After groping, the police quickly found the target vehicle. After exploring the surrounding terrain, they made a detailed plan and launched the arrest operation.

　　After testing, the items contained in the plastic bag extracted by the police from the woman’s car that day were confirmed to be ice, weighing 1000.06 grams. As a result, Panyu police detained the female object Liu Youdi, but in the subsequent trial, she always denied that the bag of ice was her own. Liu Youdi said that she is a Wechat business who is engaged in bird’s nest business. On that day, she took some bird’s nest for her friend Zhou to help sell, and this bag was put in the car when Zhou left. Liu Youdi said that there was an economic dispute between her and Zhou, so she suspected that this bag of drugs was used by Zhou to frame herself.

　　In the subsequent investigation, the police also found that just the day before Liu Youdi was arrested, she had been to Shanwei, Guangdong Province, and her own explanation was to go to Shanwei to find someone to buy bird’s nest. Liu Youdi not only refused to admit this series of evidence pointing to her suspected crime, but also had his own set of rhetoric, which also made the prosecutor of Panyu District Procuratorate doubt whether he could approve the arrest.

　　According to the preliminary investigation and evidence collection, Panyu District People’s Procuratorate approved the arrest of Liu Youdi according to law, and then the case entered the stage of review and prosecution. The prosecutor found that from the chat record, Liu Youdi had a very close relationship with Zhou who appeared in her car on the day of the incident. It should be said that Zhou was also a very key witness in the case. But in the existing evidence, there is no material of her testimony. Under the existing evidence, the procuratorate can only prosecute Liu Youdi for the crime of illegal possession of drugs.

In her testimony, Liu Youdi was mentioned to have bought and sold drugs. As a result, the nature of the case changed. 　　After obtaining new evidence, the procuratorate changed from "illegal possession of drugs" to "drug trafficking" and filed a public prosecution with the court. However, the next court trial process was full of twists and turns. In the trial, the first problem is the "zero confession".
