In order to strengthen the modernization of the grass-roots governance system and governance capacity, according to the administrative licensing law of People’s Republic of China (PRC), the administrative punishment law of the People’s Republic of China and other laws and the relevant reform work arrangements of the central government, the provincial people’s government decided to publish the Basic Catalogue of Administrative Powers of Villages and Towns (Streets) in Yunnan Province (2023 Edition) and the Guiding Catalogue of Some County-level Administrative Powers of Villages and Towns (Streets) in Yunnan Province (2023 Edition) (hereinafter referred to as All localities and departments should improve their political positions, strengthen overall coordination, and do a good job in organization and implementation in light of actual work.

First, strengthen organizational leadership.

Grassroots governance is the cornerstone of national governance. It is an important content to deepen the reform of grass-roots management system, an important task to build a simple and efficient grass-roots management system, and an important basic work to strengthen grass-roots governance and enhance grass-roots governance ability to clarify the basic functions and powers of villages and towns (streets), empower them and expand their capabilities. All localities and departments should adhere to the guidance of Socialism with Chinese characteristics Thought of the Supreme Leader in the New Era, fully implement the spirit of the 20th Party Congress, thoroughly implement the spirit of the important speech made by General Secretary of the Supreme Leader during his inspection of Yunnan, and further promote the modernization of grassroots governance system and governance capacity. The state and municipal people’s governments should strengthen their leadership and make overall plans to implement the Basic Catalogue of Administrative Powers and the Guidance Catalogue of Administrative Empowerment; The people’s governments of counties, cities and districts are responsible for the compilation, dynamic adjustment and daily management of the power and responsibility list of townships (streets), and guide the township (streets) to organize and implement the power and responsibility list; Villages and towns (streets) are the main implementers of the list of rights and responsibilities, and it is necessary to standardize the exercise of various administrative powers and continuously improve the governance capacity and efficiency of grassroots.

Second, accurately compile the list of powers and responsibilities

The functions and powers specified in the Basic Catalogue of Administrative Functions are the legal functions and powers explicitly authorized by laws, regulations and rules to be exercised by towns (streets); The Guiding Catalogue of Administrative Empowerment is a guiding catalogue. Each township (street) can scientifically evaluate its undertaking capacity according to the needs of economic and social development and select empowerment items in the catalogue. The Basic Catalogue of Administrative Powers and Duties, the statutory powers and responsibilities clearly defined by the relevant local legislation, and the empowerment matters in the Guiding Catalogue of Administrative Empowerment selected by the township (street) according to the actual needs and undertaking capacity constitute the list of powers and responsibilities of the township (street).

The compilation of township (street) power and responsibility list shall be organized and implemented by the county-level power and responsibility list management department under the leadership of the county, city and district people’s governments. Counties, cities and districts can put forward some matters that need unified empowerment according to local actual research. Counties, cities and districts should complete the list of powers and responsibilities of towns (streets) under their jurisdiction within 9 months after the announcement of this decision, and implement "a list of towns (streets)", which will be promulgated and implemented to the public according to law after being examined and approved by the county-level government. After the relevant administrative authority is entrusted to the township (street), the county-level industry department will no longer implement it. Matters included in the list of township (street) government services shall be implemented in accordance with relevant regulations.

When compiling the list of powers and responsibilities of villages and towns (streets), it is necessary to adhere to the principle that "legal responsibilities must be", and the legal powers clearly defined in the Basic Catalogue of Administrative Powers and relevant local legislation are included in the list, and it is strictly forbidden to reduce the powers and responsibilities without authorization; To select empowerment matters, according to the procedure of "township (street) selection, department evaluation and county determination", the township (street) selection and the county-level power and responsibility list management department organize relevant departments to evaluate, and the county, city and district people’s governments determine whether to empower. All localities should establish and improve the township (street) responsibility access system, and the county-level departments shall not arbitrarily hand over the administrative powers that should be borne by themselves to the township (street).

Third, strengthen the ability to perform their duties

All localities should strengthen the construction of the ability of villages and towns (streets) to perform their duties, insist on shifting the focus, sinking the strength and ensuring the downward inclination, actively promote the flow of personnel and public service resources to villages and towns (streets), so that power, people and money can be transferred with each other, and promote grass-roots affairs to be done at the grass-roots level, and grass-roots power to be given to the grass-roots level and grass-roots affairs to be done by people. It is necessary to establish and improve the relevant system measures and workflow for the operation of township (street) administrative functions and powers; It is necessary to strengthen the protection of talents, technology, funds and equipment for townships (streets) to exercise administrative functions and powers; It is necessary to strengthen the construction of comprehensive administrative law enforcement teams in towns (streets), and establish a comprehensive administrative law enforcement team in towns (streets) in a substantive manner, equipped with personnel forces that are suitable for law enforcement tasks.

All localities should strengthen accurate empowerment, and in accordance with the principle of "training first and then decentralization", before the release of the power and responsibility list of towns (streets), the power and responsibility list management department will organize the relevant industry authorities to seriously do business training on empowerment matters, and mature and decentralize a batch. After the township (street) empowerment, after a period of operation, it is still unable to meet and manage the empowerment issues, and all localities should make timely adjustments in light of the actual situation to ensure the effectiveness and accuracy of empowerment.

Fourth, strengthen supervision and evaluation and dynamic adjustment

All localities and relevant departments should strengthen the supervision, evaluation and supervision over the implementation of the Basic Catalogue of Administrative Powers and the Guidance Catalogue of Administrative Empowerment in townships (streets), so as to ensure that the statutory powers are effectively performed and that the empowerment matters are put down, accepted and managed well. County, city, district party committee office, bureau of justice, government service management bureau is responsible for the daily supervision of the implementation of the "basic catalogue of administrative powers" and "administrative empowerment guidance catalogue"; State and municipal Party committees, the Bureau of Justice, and the Administration of Government Affairs are responsible for taking the lead in timely evaluating the implementation of the Basic Catalogue of Administrative Powers and the Guidance Catalogue of Administrative Empowerment in local towns (streets). The Provincial Party Committee, the Provincial Department of Justice, and the Provincial Administrative Service Administration shall supervise the implementation of the Basic Catalogue of Administrative Powers and the Guidance Catalogue of Administrative Empowerment in a timely manner.

The dynamic adjustment of "Basic Catalogue of Administrative Powers" and "Guidance Catalogue of Administrative Empowerment" shall be organized by the provincial level in a unified way, and shall be adjusted once every two years in principle. Adjust the "basic catalogue of administrative functions and powers", organized by the provincial party committee, and published jointly with the Provincial Department of Justice and the Provincial Administrative Service Administration; Adjust the "administrative empowerment guidance catalogue", organized by the Provincial Department of Justice and the Provincial Administration of Government Affairs, and published after being approved by the provincial people’s government in accordance with the procedures.

The list of powers and responsibilities of villages and towns (streets) should be dynamically adjusted in time. After the adjustment of "Basic Catalogue of Administrative Powers" and "Guidance Catalogue of Administrative Empowerment", the list of powers and responsibilities of townships (streets) shall be organized by the provincial level for follow-up adjustment; If the list of powers and responsibilities of townships (streets) is adjusted according to the relevant local legislation, or the list of powers and responsibilities of townships (streets) is adjusted according to the needs of work, the counties, cities and districts shall organize the implementation by themselves. Before the relevant laws and regulations are changed and abolished, and the list of powers and responsibilities of towns (streets) has not been dynamically adjusted, towns (streets) should be strictly implemented in accordance with the provisions of new laws and regulations.
